Child Support in California

February 2, 2012 by Otis No Comments »

When a marital or domestic relationship ends, the ties between couples dissolve. But the ties and responsibility of parents to provide for children of that relationship do not.

Providing for the financial and other needs of a child is the responsibility of both parents. A request for child support in Santa Barbara, or elsewhere in California, can be made during legal actions for divorce, paternity, legal separation, domestic violence restraining orders, or in cases brought by parents through and by the local child support agency (LCSA).

The California Department of Child Support Services works with parents and guardians to receive, coordinate, and disburse child support. The agency also acts as a resource for parents requiring assistance with enforcement of child support orders. Assistance with collection of child support can take a variety of forms, including the following:

  • Wage garnishment
  • Report of non-payment to credit agencies
  • Referral to California Child Support Collection service
  • Placement of property and other liens
  • Seizure of tax refunds
  • Suspension of passport, driver, and professional licenses

Child Support Services also assists non-custodial parents who are having difficulty making payments and provides programs and help with overdue child support.

Children are the future, and until they reach 18, all children are entitled to financial and medical support. If you have questions concerning child support, speak with a Santa Barbara child support attorney to get the answers you and your children need.

A Troubled Family: Domestic Violence in Texas

December 27, 2011 by Otis No Comments »

Domestic violence in Texas?and anywhere in the United States?is a serious and disturbing social, legal, and community problem.? Acts of violence or threatened acts of violence occur every day behind closed doors in families of all economic and racial backgrounds.? When an adult or child is threatened or harmed, we all suffer the consequences.

Both men and women are victims of domestic violence, but most are women.? The National Coalition Against Domestic Violence (NCADV) estimates 85 percent of victims are women.? According to the Texas Council on Family Violence, 142 women were killed by their male partner in 2010, 111 women died at the hands of a loved one in 2009.

In Texas, Battering Intervention and Prevention Program (BIPP) counsels family violence offenders in a group setting.? A BIPP offered by the Domestic Violence Institute of Texas gives instruction and offers reflection for male batters to recognize and control their behavior.

Recently approved for Probationary Accreditation by the Texas Department of Criminal Justice-Community Justice Assistance Division (TDCJ-CJAD), this program aims to aid the larger community by deterring battering on an individual basis.

A child witnessing violence between parents or caretakers is the single strongest factor for transmitting violence from one generation to the next, according to NCADV.? To stop domestic violence in the future, it has to be addressed now.

If you are the victim of battering, of if you know someone who is, contact a family attorney in Fort Worth or elsewhere in Texas, or call the police.? Help yourself, help your children?and help the future.

Offering comprehensive and compassionate representation on divorce, child custody, domestic violence and other matters, the Fort Worth divorce attorneys at provide strong legal advocacy to clients.

Texting and Divorce

When Text Messaging Becomes Cheating

Rapid and novel advances in technology have changed the way we work, live, and communicate and apparently the way we cheat on our spouses.

Along with instant messaging, Facebook, and email comes the pleasures of cellular technology.? Sexting sending compromising photographs via cell phone was the undoing of New York Representative Anthony Weiner, and chexting, or using text messaging to facilitate infidelity, rapidly reduced the marital bliss of Tiger Woods to rubble.

When discussing reasons for chexting, therapists point to the thrill of a secret liaison combined with provocative text that provides a sexual and emotional charge each time it is read.

Is it cheating?

Just like sexting and lurid emails, chexting does not always involve physical contact.? Is it cheating if a spouse or partner is exchanging intimate thoughts with another?

While sexual affairs are a solid, time-honored basis for marital break-up, so are the chexts and emails that speak to such affairs, even if never consummated. It is loss of intimacy?in communication, and in deepest desire?that fuels the anger and sense of betrayal of those who find their partner is thoughtfully involved with another.

Both therapists and divorce attorneys handle the consequences of the discovery of chext messages and other titillating electronic communications.? Even in states with no-fault divorce, episodes of chexting and sexting are used to influence facets of a divorce case in court, including custody matters.

Within a committed relationship, technology used to text or send suggestive email may help partners regain or retain some of their original spark.? However, for those whose fingers wander even in a text or other message the results can be heartbreaking.

Buffalo divorce attorneys have decades of experience helping clients in Western New York successfully navigate marital dissolution, asset division, and custody issues from start to finish.? If considering divorce, they offer high quality representation and compassionate legal service.

Hire a Divorce Lawyer Before It’s Too Late

It is important to have an experienced attorney by your side when you are going through a divorce. Your lawyer can help you to focus on the tasks necessary to get to the future, and can present an objective view of your situation that is stripped of emotional baggage. Divorce is an emotional roller coaster that can plummet you into grief, pain, and anger. Add in confusing legal documents and you can be left struggling to move forward with your new life.

Find an Experienced Firm

Knowing and understanding your legal rights during a divorce or separation is extremely important. Your attorney can counsel you on local laws and provide you with advice on the options available to you. Lawyers can also help you in the following ways:

  • Preliminary investigation. An Alpharetta child custody lawyer discusses your case with you and explains the divorce process and what you are required to do.
  • Filing the petition. Roswell divorce law firms can assist you in filing a petition for divorce with your local court.
  • Division of property and assets. Your attorney can advise you on how to divide the property and assets you and your spouse accumulated over the course of your marriage. In Georgia, assets and debts acquired during your marriage, called marital property, will be divided equitably when you divorce. Not all property is marital property.
  • Child custody. When children are involved, a divorce can quickly become hostile.
  • Collaborative divorce. In a collaborative divorce couples take a non-adversarial approach and each is represented by a lawyer with training in the collaborative process. The parties reach an amicable agreement that accommodates the interests of the entire family without going to court.
  • Separation. In Georgia, a court does not grant you a legal separation. Rather, you must swear that you are in an actual state of separation and then the court can grant a divorce or an Order for Separate Maintenance. Your attorney can advise you on the reasons to pursue this type of case instead of a divorce.
